Why this matters
The HR-1 law brought new fees: $100 for asylum, $102 annually while the case stays pending, and the asylum/parole/TPS EAD rose to $1,000.
What changed
The HR-1 law (“One Big Beautiful Bill”) created new fees and increases that took effect in 2025–2026. The most important changes for our communities:
- Asylum: a $100 filing fee and a $102 annual fee for each year the case stays pending. No waiver.
- Work permit (EAD) for asylum, parole, or TPS: rose from $630 to $1,000.
- Inflation-adjusted fees took effect on January 1, 2026.
Watch the annual asylum fee
Not paying within 30 days of the notice can lead to rejection of the application, loss of the work permit, and, in some cases, removal proceedings. Keep a payment calendar.
What to do
- Verify the exact amount on the USCIS fee calculator the day you file.
- Mark the dates of the annual fee if you have a pending asylum case.
- Check whether you qualify for a reduced fee (where it applies).
